Terms of Service

These terms govern your use of the SunnyGap mobile app ("the app", "the service"), operated by an independent developer based in Croatia ("we", "us"). By creating an account or using the app, you agree to these terms. If you do not agree, do not use the app.

1. What SunnyGap is

SunnyGap scores upcoming weather for outdoor activities and shows you the best windows in the week ahead. The free tier includes the full 7-day outlook. An optional premium subscription adds smart push notifications.

2. Weather is a forecast, not a promise

Important: SunnyGap's scores are derived from third-party weather forecasts. Forecasts are inherently uncertain and can be wrong. The app is a convenience tool, not a safety service.

Do not rely on SunnyGap for any decision where weather poses a safety risk. Always check official weather warnings and use your own judgment before heading out. We accept no responsibility for decisions you make based on the app's scores.

3. Your account

You must provide accurate information when creating an account and keep your credentials secure.
You are responsible for activity that happens under your account.
You must be at least 16 years old to use the service.
You can delete your account at any time in Settings → Delete Account, which permanently removes your data (see our Privacy Policy).

4. Premium subscription

SunnyGap Premium is a monthly auto-renewing subscription purchased through Apple's In-App Purchase system. The current price is shown in the app before you buy.
Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
You can manage or cancel your subscription at any time in your Apple Account settings (Settings → Apple Account → Subscriptions). Deleting the app does not cancel the subscription.
Refunds are handled by Apple under Apple's refund policy; we cannot issue refunds directly.
We may change subscription pricing for new subscribers. Existing subscribers will be notified of any price change as required by Apple's policies.

5. Acceptable use

You agree not to: abuse, overload, or attempt to disrupt the service; attempt to access other users' data; reverse-engineer, scrape, or resell the service or its data; or use the service for anything unlawful. We may suspend or terminate accounts that violate these terms.

6. Intellectual property

The app, its design, scoring algorithms, and content are owned by us. We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as permitted by the App Store terms. Weather data is provided by Open-Meteo.

Your download and use of the app are additionally governed by Apple's Licensed Application End User License Agreement (the standard EULA). These terms apply in addition to it; where the two conflict regarding the app licence itself, the standard EULA prevails. These terms are concluded between you and us only, not with Apple, and Apple is not responsible for the app or its content.

7. Availability and changes

We aim to keep the service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features at any time. If we discontinue the premium service entirely, active subscriptions will not renew.

8. Disclaimer and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of weather information. To the maximum extent permitted by law, our total liability for any claim arising from your use of the service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded under applicable law, and nothing affects your statutory rights as a consumer in the EU.

9. Governing law

These terms are governed by the laws of Croatia. If you are an EU consumer, you also benefit from the mandatory consumer protection rules of your country of residence.

10. Changes to these terms

We may update these terms from time to time. Material changes will be announced in the app or by email, and the "last updated" date above will change. Continued use after changes take effect constitutes acceptance.
